1. Agreement to Terms
By accessing or using Pacto ("Service"), operated by Sitka Labs ("we," "us," or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you disagree with any part of these terms, you may not use our Service.
2. Description of Service
Pacto provides marketplace alert notifications for Facebook Marketplace. We monitor listings based on your preferences and send notifications when matching items are found. We are not affiliated with, endorsed by, or connected to Meta, Facebook, or Facebook Marketplace.
3. Account Registration
3.1 Account Requirements
- You must be at least 13 years old to use Pacto
- You must provide accurate and complete registration information
- One account per person only
- You are responsible for maintaining account security
- You must notify us immediately of any unauthorized access
3.2 Account Restrictions
- Accounts may not be shared, sold, or transferred
- Businesses/teams may not share accounts
- Creating multiple accounts is prohibited
- Automated account creation is prohibited
4. Subscriptions and Billing
4.1 Plans and Pricing
- Subscription plans are billed monthly through Apple App Store
- Prices are subject to change with 30 days notice
- All prices are in USD unless otherwise stated
4.2 Free Trial
- New users receive one 7-day free trial
- Trial automatically converts to your selected paid plan
- Cancel before trial ends to avoid charges
- Only one free trial per person (multiple trials prohibited)
4.3 Credits
- Each plan includes a specific number of credits per month
- Credits reset monthly
- Unused credits expire at the end of each billing cycle
- Credits cannot be purchased separately; upgrade your plan for more credits
- Credits are non-transferable and have no cash value
4.4 Plan Changes
- Upgrades take effect immediately with prorated billing
- Downgrades take effect at the next billing cycle
- Credits from higher plans remain available until next billing cycle when downgrading
4.5 Refunds
- All purchases are final
- Refunds are handled per Apple's App Store policies
- No refunds for unused credits or partial months
- No refunds due to service disruptions beyond our control
5. Acceptable Use Policy
5.1 You May Not:
- Resell, redistribute, or provide commercial access to the Service
- Use the Service to spam, harass, or abuse marketplace sellers
- Attempt to circumvent credit limits or subscription requirements
- Reverse engineer, decompile, or copy our Service or methods
- Violate any applicable laws or regulations
- Use the Service for any illegal or fraudulent purpose
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Copy or imitate our credit system model or business methods
5.2 Content Standards
- Search terms must not violate any laws
- You may not search for illegal items or services
- We reserve the right to refuse service for inappropriate searches
6. Service Availability and Modifications
6.1 Service Availability
- We strive for continuous availability but do not guarantee uninterrupted service
- "Instant" alerts scan at minimum every minute, but speed may vary based on system load
- Alert delivery depends on various factors including network conditions
- We reserve the right to modify or discontinue features with notice
6.2 Third-Party Dependence
- Our Service depends on Facebook Marketplace remaining accessible
- We are not responsible for changes to Facebook's policies or systems
- Service may be interrupted or terminated if Facebook restricts access
- No refunds will be provided for disruptions outside our control
6.3 Disclaimer of Warranties
- Service is provided "as is" and "as available"
- We make no warranties about listing completeness or accuracy
- Some marketplace listings may be missed due to Facebook's algorithms, review processes, or visibility settings
- We do not guarantee you will successfully purchase any items
- We do not guarantee any profit or business success
- We are not responsible for scams, fraud, or misrepresented listings
7. Limitation of Liability
7.1 Limitations
Our total liability for any claims under these Terms is limited to the amount you paid us in the last 12 months. We are not liable for:
- Indirect, incidental, special, or consequential damages
- Lost profits or revenue
- Loss of data or use
- Deals that turn out to be scams or fraudulent
- Missed opportunities or listings
- Actions of third parties, including sellers
7.2 Indemnification
You agree to indemnify and hold harmless Sitka Labs from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
8. Intellectual Property
8.1 Our Property
All Service content, features, and functionality are owned by Sitka Labs and protected by intellectual property laws. This includes but is not limited to:
- Our credit-based pricing system
- Alert algorithms and methods
- Software code and architecture
- Logos, designs, and branding
8.2 User Content
- You retain rights to your personal information
- Search configurations and preferences are our property
- By sharing success stories or feedback, you grant us permission to use them for marketing (with your consent)
- We may aggregate and anonymize user data for improvements
9. Account Termination
9.1 Termination by You
- You may cancel your subscription anytime through the App Store
- Account deletion can be requested via support@trypacto.com
9.2 Termination by Us
We may suspend or terminate accounts for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abusive behavior toward staff or other users
- Attempting to manipulate or hack the Service
- Creating multiple accounts
- Payment failures or chargebacks
- Any activity that harms the Service or other users
9.3 Effect of Termination
- Unused credits are forfeited upon termination
- No refunds for banned accounts
- We may retain certain data as required by law
11. Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.
11.2 Dispute Process
- First attempt: Contact support@trypacto.com for resolution
- If unresolved: Binding arbitration in British Columbia
- Small claims court is available for qualifying disputes
- Class action lawsuits and class arbitrations are not permitted
12. Apple App Store Terms
12.1 Additional Terms
Your use is also subject to Apple's Terms of Use and App Store Review Guidelines.
12.2 In-App Purchases
- All subscription billing is handled by Apple
- Payment disputes should be directed to Apple Support
- Apple's refund policies apply to all purchases
13. Changes to Terms
We may update these Terms at any time. We will notify you of material changes via:
- In-app notification
- Email notification
- Notice upon app launch
Continued use after changes constitutes acceptance of new Terms.
14. Miscellaneous
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Sitka Labs.
14.2 Severability
If any provision is found unenforceable, the remaining provisions continue in effect.
14.3 No Waiver
Our failure to enforce any right or provision is not a waiver of that right.
14.4 Assignment
You may not assign or transfer these Terms. We may assign them without restriction.
14.5 Force Majeure
We are not liable for failures due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
